Rental Agreement

This Rental Agreement (“Agreement”) governs the rental of equipment and services from Elmer’s Event Rentals & DP (“Company,” “we,” “us”) to the undersigned customer (“Client,” “you”). By placing an order, signing electronically, or otherwise accepting delivery, you agree to the following terms and conditions:

Booking, Payments & Cancellations

To confirm your rental, full payment or a required deposit must be received.

Cancellations:

  • More than 3 days before delivery → 50% of contract price charged.
  • Within 3 days of delivery → 100% of contract price charged.
  • Once equipment has left our warehouse, no refunds will be issued.

You are responsible for all items and services on the invoice, including damages, losses, modifications, or additional labor.

Rental Delivery

  • Minimum order for delivery is $400 (before delivery fees and taxes).
  • Local delivery fee: $75.
  • Other areas/out-of-state: Delivery fees vary by distance, time, and accessibility.
  • Delivery times are estimates, not guarantees. We are not responsible for delays caused by traffic, weather, vehicle issues, or events outside our control (“force majeure”).

Client Responsibilities

  • You or your representative must be present at delivery to inspect and sign for items.
  • Any damages or issues must be reported in writing before your event begins. Failure to report issues before use waives your right to refunds or credits.
  • Once our team leaves the delivery site, no modifications or item exchanges will be accepted.

Company Responsibilities

  • We provide rental items in clean, working condition.
  • Due to manufacturer variations and prior usage, equipment may not exactly match photos.
  • At our discretion, we may substitute items with functionally equivalent alternatives.

Acceptable Use

  • Rentals are for your event only. You may not sublease, loan, or rent them to others.
  • If any item becomes unsafe or damaged, stop using it immediately, secure the area, and contact us.

Loss, Damage & Cleaning Fees

You are financially responsible for any loss, theft, damage, or destruction of rented equipment from delivery until pick-up.

Charges:

  • Replacement at full retail value, or at our discretion, repair costs.
  • $50 service fee per damaged item (e.g., stapling, gluing, nailing).
  • Additional charges for excessive cleaning (wax, food stains, burns, etc.).
  • Linens: must be returned free of stains, burns, and candle wax, and placed in provided bags.
  • Dishware/Glassware/Silverware: must be rinsed of food debris.

Rental Period & Extensions

Standard rentals are charged in 24-hour increments (except Friday-to-Monday weekend rentals, which are billed as one period).

Extensions must be approved in writing before the rental period ends. Additional fees apply if items are kept beyond the agreed return time.

End of Rental Period

  • At pick-up, all items must be repacked in original containers/crates and accessible for loading.
  • If items are not ready or accessible, additional labor charges will apply.
  • If conditions prevent pickup, you may be required to return items to our warehouse at your expense.

Post-Rental Process

  • Within 2 business days of pick-up, we will send an invoice for any missing or damaged items.
  • If missing items are not returned within 24 hours of notice, your credit card on file will be charged automatically for replacement costs.

Legal & Liability

  • Client assumes all risks associated with rental items, including their transport, use, and storage.
  • Elmer’s Event Rentals & DP is not liable for accidents, injuries, property damage, or event disruptions related to rental items.
  • You agree to indemnify and hold harmless Elmer’s Event Rentals & DP, its employees, and partners, from all claims, damages, or losses arising from your use of rentals.
  • Disputes will be resolved by binding arbitration in Bergen County, NJ under the United States Arbitration Act. Judgments may be entered in any court with jurisdiction.
  • If any clause of this Agreement is found unenforceable, the remainder shall remain valid.

Acceptance

By placing an order or receiving equipment, you agree to all terms in this Agreement. These terms apply to all invoices from Elmer’s Event Rentals & DP, regardless of whether additional terms appear on specific contracts.

Weather & Outdoor Events

Client acknowledges that outdoor events carry weather-related risks (rain, wind, snow, extreme heat/cold, etc.).

Tents and outdoor equipment must be secured properly at all times. The Company may refuse setup if conditions are unsafe.

If severe weather (including but not limited to heavy winds, thunderstorms, flooding, or snow) poses a risk to equipment, staff, or guests, the Company reserves the right to delay, adjust, or cancel installation/pick-up without liability.

Client is responsible for:

  • Monitoring weather conditions before and during the event.
  • Taking reasonable steps to protect rented items during the rental period (covering, securing, etc.).
  • Any damage to equipment caused by weather after setup is complete.

Refunds will not be provided for weather-related cancellations once equipment has been delivered.
